CATS PURCHASE /SALES AGREEMENT

sell this Maine Coon Kitten/Cat (referred to hereafter as “cat”)
described below to the Purchaser:

This purebred Maine Coon
Cat is sold as a pet, to be cared for in the Purchaser’s home and given
frequent kind human attention. The Purchaser(s) agrees not to breed this
cat, and to have it the cat altered before the age of twelve months if it
has not been altered by the time of sale.
The breeder will furnish
the Purchaser(s) with the cats registration slips at the time of sale if the
cat is already altered, or upon receipt of documentation from the
veterinarian performing the neuter/spay operation. Because this Cat is being
sold as Pet Quality, the Purchaser(s) agrees that the cat will not be shown
in competition without written permission from the Breeder.
The Purchaser(s) agrees
not to sell the cat, give the cat away, or permit it to be destroyed without
first giving the Breeder the right to re-purchase the cat for no more than
the original purchase price paid by the Purchaser(s). The purchaser further
agrees under no circumstances will the cat be abandoned or given or sold to
a shelter or pet store, laboratory or research facility of any kind, whether
or not the Breeder exercises the option to re-purchase the cat.
The Purchaser(s) agrees
to have the cat vaccinated as recommended by his veterinarian with a 3 way
vaccine. The Purchaser(s) agrees to have the cat examined at least yearly by
a licensed veterinarian and that the cat will not be denied needed medical
attention. If the Purchaser(s) is unsure whether the animal is in need of
medical attention, a licensed veterinarian will be consulted, the situation
explained, and the vet’s advice acted upon.
The Purchaser(s) agrees
that the cat will not be allowed outdoors unless confined to a carrier, on a
leash under close supervision, or in a completely enclosed run. The
Purchaser(s) agrees that the cat will be given a proper diet and have fresh
water available at all times. The Purchaser(s) agrees not to cause or permit
the cat to be de-clawed or given a tendenectomy.
The Breeder represents
that the cat is, to the best of her knowledge, healthy at the time of sale
and has had the inoculations shown on the health record provided with the
cat. The Breeder provides the following health guarantee:
At the time of delivery,
the cat is guaranteed to be FeLV and FIV negative and free from viral and
bacteria diseases, fungus infections and internal and external parasites.
Disclaimer: All
Tropikoons Breeding cats are screened for Hip Dysplasia and are Screened for
Hypertrophic Cardiomyopathy, both known genetic diseases in the Maine Coon.
Although parents are screened and cleared there is no guarantee that
that this cat could not develop either of these diseases.
This Breeder Guarantee Waives All guarantees given by the Florida
State Lemon Law.
IN ORDER TO QUALIFY
FOR THE ABOVE GUARANTEE, THE PURCHASER MUST HAVE THE CAT EXAMINED BY A
VETERINARIAN, AT THE PURCHASER’S EXPENSE, WITHIN 48 HOURS OF DELIVERY
(EXCLUDING SUNDAYS AND HOLIDAYS)
If, at this examination,
the cat is found to have any of the conditions listed above and in the
opinion of the vet, the condition was present at the time of delivery, the
Breeder will be notified immediately and will, upon receipt of a written
statement from the examining vet that the condition was present at delivery,
pay the cost of the medical treatment necessary to correct the
condition, up to the purchase price of the animal. The Breeder shall have
the option of having the cat examined and treated by her veterinarian. If
the cost of the treatment is expected to exceed the purchase price, the
Purchaser shall have the option to return the cat to the Breeder for a full
refund of the purchase price.
All health guarantees are
void if the cat is given the FeLV or FIP vaccine.
The Breeder offers no
guarantee other than that contained in this agreement. The liability of the
breeder, under this guarantee, shall not exceed the purchase price of the
animal.
If the Purchaser, having
put a deposit on a cat, should decide to cancel the purchase prior to
delivery, the deposit will be refunded upon re-sale of the cat by the
Breeder for at least the agreed upon Purchase price. If the cat is
subsequently re-sold for less than the agreed upon purchase price, the
deposit will be refunded less the difference between the agreed upon
purchase price and the re-sale price.
The Purchaser’s failure
to adhere to the terms and conditions set forth in this agreement shall
entitle the Breeder to recover from the Purchaser fixed and agreed upon
damages in the specific amount of one thousand dollars ($1,000.00). The
Purchaser(s) shall be responsible for any and all costs of enforcing the
provisions of this agreement and/or collecting any moneys that may be due
the Breeder under the terms of this agreement. The parties agree that this
agreement is made under the laws of the state of Virginia. If any provision
of the agreement conflicts with those laws, the provision of the agreement
not in conflict shall continue to bind the parties, and the provisions in
conflict shall be deemed to have been modified in accordance with the
applicable law. The Purchaser(s) agree
to pay all court costs if this contract is litigated in the State of
Florida, under Florida law.
It is the intent of the
Breeder and the Purchaser(s) that this agreement shall constitute a legally
binding contract, representing the entire agreement between the parties.
Neither party shall have the right to modify it except by mutual agreement
in writing.
By signing this agreement
the Purchaser(s) acknowledges that he/she has read, fully understands,
agrees to and has received a copy of this agreement.
